Article 30-T2-Disciplinary Correctional Facility |
| 30.1 |
T2-Disciplinary Correctional
Facility |
| |
By this code, such facilities shall exist and be known as T2 Disciplinary Correctional Facilities for the exclusive detainment of all prisoners sentenced to a custodial sentence greater than three (3) years and not exceeding twelve (12) years and convicted of violent crimes, sexual related crimes, anti-social crimes having shown an unwillingness and/or disregard to a personal reform program through the other T2 correctional facilities. |
| |
No other correctional facilities shall be permitted to be temporarily or permanently used for such purpose other than those solely constructed and managed for this specific purpose. |
| |
It is the responsibility of the Office of Corrections to closely monitor the impact of the actions of the police, military and the courts in respect to the demand for T2 Disciplinary Correctional Facility places and to alert Government to budgetary savings or capital requirements depending upon the general trend and demands. |
| 30.2 |
General context of a T2 Disciplinary Correctional Facility |
| |
Individuals who have been convicted of medium term custodial sentences relating to violent crimes, sexual related crimes and anti-social crimes are by definition considered some danger to society, where the court and the nature and circumstances of the crime warrant a medium term custodial sentence. |
| |
However, the absence of a long term sentence indicates to some degree a willingness of society through the courts to see that individual re-integrated back into society as some time within a medium term. |
| |
Therefore, it is implied that such offenders and criminals convicted of medium term sentences are expected to reform and cease such criminal activity that led to their arrest, and imprisonment. |
| |
By this code, a range of T2 type facilities shall be made available for the training, development and reintegration of convicted criminals back into society. These shall be the first line programs for all T2 classified prisoners and include military, education, community and medical correctional facilities. |
| |
Where an individual prisoner fails in their program in one of these other facilities by being charged and found guilty of a medium to serious criminal act, they shall be excluded from all other types of T2 facilities and placed in a T2 Disciplinary Correctional Facility for the duration of their sentence. |
| |
A T2 Disciplinary Correctional Facility is therefore designed to be harsh, austere, militaristic and unyielding. |
| 30.3 |
Condition of classification of a prisoner to a T2 Disciplinary Correctional Facility |
| |
By this Code, it shall be considered an offence to classify a T2 prisoner immediately to a T2 Disciplinary Correctional Facility unless the crimes for which they have been convicted are especially violent crimes, sexual related crimes and that the Classification Report prepared for the Courts and the office of Corrections deems the prisoner ineligible for any other T2 type facility. |
