T2-Military Correctional
Facility |
| |
By this code, such facilities shall exist and be known as Military Correctional Facilities for the exclusive detainment of all prisoners sentenced to a custodial sentence greater than three (3) years and not exceeding twelve (12) years and convicted of violent crimes and other anti-social crimes who have shown a proven aptitude for conditional military service . |
| |
No other correctional facilities shall be permitted to be temporarily or permanently used for such purpose other than those solely constructed and managed for this specific purpose. |
| |
It is the responsibility of the Office of Corrections to closely monitor the impact of the actions of the police, military and the courts in respect to the demand for T2 Military Correctional Facility places and to alert Government to budgetary savings or capital requirements depending upon the general trend and demands. |
| 31.2 |
General context of a T2-Military Correctional
Facility |
| |
Individuals who have been convicted of medium term custodial sentences relating to violent crimes, gang related crimes and anti-social crimes are by definition considered some danger to society, where the court and the nature and circumstances of the crime warrant a medium term custodial sentence. |
| |
However, the absence of a long term sentence indicates to some degree a willingness of society through the courts to see that individual re-integrated back into society as some time within a medium term. |
| |
Therefore, it is implied that such offenders and criminals convicted of medium term sentences are expected to reform and cease such criminal activity that led to their arrest, and imprisonment. |
| |
In the case of violent individuals who hold an affiliation to a gang, their assigned to maxumum security facilities without addressing the fundamental need to help them reset their loyalties, and sense of purpose only renders a more dedicated class of criminals. |
| |
The purposes of T2 Military Type Correctional Facilities is to encourage such individuals to undertake practical training and discipline within a strict military regime, whilst learning and applying a greater degree of self discipline and control over violent and anti-social behaviour. |
| |
Military Type Correctional Facilities shall always be remote to main population centres, with prisoners permitted to serve only in foreign actions as needed. |
| 31.3 |
Condition of classification of a prisoner to a T2-Military Correctional
Facility |
| |
By this Code, it shall be considered a criminal offence to classify a T2 prisoner immediately to a T2 Military Correctional Facility. An individual shall be eligible for re-classification only after a minimum of twelve (12) months of good behaviour has been served. |
